Compensate can be broken down into the following components:

• Antecedents: Overview of the key facts of the matter
• Past Out of Pocket Expenses: Calculates costs already incurred for reasonable and necessary treatment or expenses
• Future Treatment Expenses: Recommended future treatment costs or expenses
• Past Care and Assistance: Damages for past gratuitous attendant care services and for loss of capacity to provide domestic services
• Future Care and Assistance: Damages for future care and assistance
• Past Economic Loss: Calculates past earnings loss, past superannuation and interest
• Future Economic Loss: Calculates future loss of earning capacity and future superannuation
• Non-economic Loss: Compensation for pain and suffering
• Deductions: Deductions to be applied against the compensation amount
• Summary: Provides a summary of all heads of damage and the total figure
• Schedule of Damages: A professionally formatted Schedule of Damages provided as both a Word document and PDF

On each of these tabs, there will be a few helper symbols that provide explainers and more information about elements on the page.

• Information icons: Opens the relevant Furzer Crestani table that is referenced in the calculation
• Lightbulb icons: Provides an explanation of what this field does
• Question icons: Provides the formula used to calculate the associated figure

We have also introduced sliding side panels on both the left and right of the app to make navigation and reference material more accessible.

Scenarios

The left side panel, opened via the vertical Scenarios tab, is where you can create and manage scenarios. Scenarios allow you to generate multiple versions of a Schedule of Damages so you can model high-end and low-end figures or test different assumptions.

New scenarios can be duplicated from existing ones, allowing previously entered information to be carried over so that only the relevant figures need to be changed. You can also rename or delete scenarios, and view when each scenario was created and last modified.

In the collapsed state, you can freely navigate between the different scenarios via the numbers on the left.

Furzer Crestani Handbook

The right-side panel, opened via the vertical Furzer Crestani tab, contains the complete Furzer Crestani Handbook.

You can navigate directly to the relevant page by scrolling through the handbook or by clicking the relevant information icons throughout the app.

The Antecedents tab is an overview of the key facts of the matter as well as providing a field to set the date the Schedule of Damages is set to be served.

These figures are designed purely to provide a brief overview of the matter and can be changed accordingly in the different tabs later.

• Plaintiff’s age: The age of the plaintiff as at the Document Date
• Life expectancy: The expected years remaining from the Document Date
• 5% multiplier for X years: The multiplier for the number of years until life expectancy
• 5% multiplier for X years (until statutory age of retirement): The multiplier for the number of years until the statutory age of retirement
• Date of incident: The accident date as set in the matter details. Other elements such as gender and age can also be changed in the matter details
• Document date: The intended submission date for the Schedule of Damages. This date can be adjusted to any date after the Date of incident.  The document date can also be changed via the scenarios side panel and updating it in either location will automatically update the other.
• Weeks since incident: The number of weeks between the Date of incident and the Document Date

Tips

• Age, life expectancy, multipliers, date of incident, and weeks since incident are all derived from the plaintiff card on the matter table.
• All values shown in the Antecedents tab are for reference only and do not affect calculations. These figures can be adjusted in later tabs wherever different values are required.
• The Document Date should be set to an expected mediation date as all time periods entered in the later tabs will be restricted to be between the Date of Incident and the Document Date.

The Past Out of Pocket Expenses tab is used to record any costs incurred for reasonable and necessary treatment or expenses.

New entries can be added with the + icon and deleted and rearranged with the respective icons on the right-hand side.

• Description: A free-text description of the entry which will be copied directly into the Schedule of Damages
• Cost: The associated cost of the entry
• Buffer: A buffer amount can be claimed in addition to, or instead of, particularised entries
• Interest claimed: The amount of interest claimed, either as a dollar amount or as a percentage

The Future Treatment Expenses tab is used to calculate the recommended future treatment costs or expenses. New entries can be added with the + icon and deleted and rearranged with the respective icons on the right-hand side.

• Cost: The associated cost of the entry. Replacement periods can be calculated by entering each annual cost and deferring the start of each new period
• Frequency: How often this cost is incurred
• Years required: Applies the 5% multiplier for the number of years required
• Years deferred: Applies the 5% multiplier for the number of years deferred

The Past Care and Assistance tab is used to calculate the damages for past gratuitous attendant care services and for loss of capacity to provide domestic services. New entries can be added with the + icon in their respective sections and with the respective icons on the right-hand side.

• Description: A free-text description of the entry which will be copied directly into the Schedule of Damages
• Start and end date: The start and end date of the care period. The start date auto-calculates as the date of incident. Click “Calculate” after any changes to update the results
• Hours per week: The number of hours per week care was provided. Click Calculate after any changes to update the results

• Hours per week: The number of hours per week care required
• Rate per hour: A free-text insertion of the hourly rate
• Number of years: Applies the 5% multiplier for the number of years required

The Past Economic Loss tab is used to calculate past earnings loss, past superannuation and interest.

• Start and end date: The start and end date of the period of loss. The start date auto-calculates as the date of incident
• Post and pre-injury gross weekly income: Required to calculate gross weekly loss
• Post and pre-injury net weekly income: Required to calculate net weekly loss
• Gross weekly loss: This will auto-calculate and is required to calculate superannuation loss. The loss amount can be changed by using the edit icons
• Net weekly loss: This will auto-calculate and is required to calculate loss of earnings. The loss amount can be changed by using the edit icons
• Past loss of superannuation: This will auto-calculate based on the government mandated superannuation guarantee percentages. Non-standard superannuation rates (different to the super guarantee percentage) can be applied by toggling the option on
• Interest claimed: The amount of interest claimed, either as a dollar amount or as a percentage

• The pre-injury gross weekly income, pre-injury net weekly income, post-injury gross weekly income and the post-injury net weekly income are optional fields. They are provided so that that the gross and net weekly loss can be calculated. If the gross and net weekly loss is known, you can directly input that into the respective fields instead.
• The Periods and Past loss of superannuation sections can be expanded or collapsed, allowing you to switch between a more concise view and a more detailed one.

The Future Economic Loss tab is used to calculate future loss of earning capacity and future superannuation.

New entries can be added with the + icon and delete with the respective icons on the right-hand side.

• Description: A free-text description of the entry which will be copied directly into the Schedule of Damages
• Expected duration of loss (years): Applies the 5% multiplier. Auto-fills to age 67 (statutory age of retirement) but can be overridden
• Years deferred: Applies the 5% multiplier for the number of years deferred
• Net weekly loss: Applies the net weekly loss from the previous section or a new custom one
• Discount for vicissitudes of life: Toggle on to apply a discount that auto-fills to 15%
• Future loss of superannuation: This will auto-calculate based on the methodology established in Najdovski -v- Crnojlovic [2008] NSWCA 175. You can instead select Custom Superannuation to enter a custom superannuation amount. This autofills with the current superannuation guarantee rate of 12%.
• Total buffer: A buffer amount can be claimed in addition sum of previous entries

The Non-Economic Loss tab calculates compensation for pain and suffering based on a percentage of the most extreme case.

• Percentage of most extreme case (MEC): The percentage of MEC between 0% and 100% and automatically applies the correct capped statutory amount

The Deductions tab calculates deductions that are to be applied against the compensation amount.

The Summary tab provides a summary of all heads of damage and the total figure.

• Generate Schedule of Damages: This generates a Schedule of Damages based on the information provided in the previous sections. The Schedule of Damages will be saved to the matter as a Word document so you can edit the look of the document to suit your purposes. Any calculation changes should be made in-app, not in Word
