NT - Litigation court forms
A litigation profile review has been carried out to ensure that the Court forms work correctly when, not only acting for ALL Defendants, but also when acting for ONE Defendant where there are multiple Defendants i.e. acting for the Second Defendant but not the First Defendant, or acting for the First and Second Defendants but not the Third Defendant, etc.
The court forms for NT have therefore been re-coded where necessary to allow for more than one of each party using the mergefield Court__List_Parties, and a new mergefield COURT__Filed_for_role where required. The forms affected are those listed below:
NT > Litigation > Local Court Litigation > LEAP Forms > Local Court
NT > Litigation > Supreme Court Litigation > LEAP Forms > Supreme Court Civil
NT > Litigation > Work Health Court > LEAP Forms > Work Health Court
MATTER SET UP:
Where there is more than one Defendant in the matter, complete as follows:
Client = Client
Other Side = Plaintiff
Other Side's Solicitor = Plaintiff's Solicitor
Edit Table Types and add the following Tables and Cards:
Defendant
Defendant's Solicitor
A new subsidiary layout has been added entitled ‘Role' which is associated with each party ie Plaintiff, Defendant and Third Party (where applicable). This new layout determines who you are acting for i.e. the Second Defendant etc:
If you are acting for ALL Defendants or if there is only one Defendant in the matter, then complete the matter setup as normal.
This same rule applies for Third Parties, i.e. you could act for one or a multiple of Third Parties but not necessarily all Third Parties. In this instance, the parties would be set up as follows:
Client = Client
Other Side = Defendant
Other Side's Solicitor = Defendant's Solicitor
Edit Table Types and add the following Tables and Cards:
Plaintiff
Plaintiff's Solicitor
Third Party
Third Party's Solicitor
Enter Third Parties in the order that they appear in the Third Party Notice i.e. if your client is the Second Third Party, then replicate the Client Card and also ensure that your Firm Details are added as Second Third Party's Solicitor.
EXAMPLE MATTER SET UP:
Our client is Joanne Penelope Smithfield and she is the Third Defendant:
