NSW - Uniform Civil Procedure Rules
We have been advised that the Uniform Rules Committee has approved the following amendments to:
- UCPR form 69 and the creation of UCPR form 71B;
- Amendment No 82 relating to the expert witness code of conduct; and
- Amendment No 83 relating to service of originating processes and other documents outside of the jurisdiction.
The creation of rule 39.43A is as a consequence of changes made to theCivil Procedure Act 2005 by theStrata Schemes Management Act 2015. These changes enable a judgment creditor, who is an owners corporation, to issue a garnishee order against rent held by a real estate agent in a trust account for the benefit of a judgment debtor that relates to an unpaid contribution.
The following form has been amended:-
- Notice of Motion - Garnishee order (form 69) - (LL-NSW-UCP077)
- Expert witness code of conduct - (LL- NSW-UCP111)
The following form has been added:-
- Garnishee order for rent (form 71B) - (LL-NSW-UCP140)
