VIC - Enduring Power of Attorney
As a result of client feedback regarding the Enduring Power of Attorney, which was based on the Office of the Public Advocate form, the enduring power of attorney has now been revised.
This revised version of the EPA, has significantly reduced the number of pages required when printing and preparation is simplified. The document is coded for five Attorneys and five Alternative Attorneys provided all required details have been completed in your matter. Should you require more than five attorneys you will need to enter the additional attorneys manually in the form.
In the Enduring Power of Attorney clients will need to enter the details of what a specific Attorney can do ie. not been appointed for all financial and personal matters. Clients will also be required to type in details of the ‘circumstances of appointment' eg. if the attorney is to be appointed at some time other than immediately or when the principal ceases to have decision making capacity.
The following documents are now available
- Enduring Power of Attorney (LL-VIC-WPA-046)
- Statement of Acceptance of Appointment – Attorney (VIC-LL-WPA-047) (to be used if appointing more than 5 attorneys)
- Statement of Acceptance of Appointment – Alternative Attorney (LL-VIC-WPA-048) (for use only if appointing more than 5 alternative attorneys)
The Statement of Acceptance of Appointments should only be used if you have appointed more than five Attorneys.
The Appointment of Supportive Attorney will be released shortly which will be in a similar format as the new Enduring Power of Attorney – watch the blog for release details.
