ACT - Power of Attorney forms

The Enduring Power of Attorney (LL-ACT-WPA-03) and General Power of Attorney (LL-ACT-WPA-02) have been extensively re-coded. All Check Boxes have been enlarged in the Enduring POA to allow the initials to be completed where applicable within the form. The forms can be used in the following matter types:
  • Power of Attorney
  • Will – One Person
  • Wills – Two people appointing each other
Ensure you haveHidden textturned on in Word by selecting File, Options, Display, then tickHidden text.Hidden text appears inbluefont. The forms now include the following features:
  • Option to prepare form for Client 1 or Client 2 in your matter
  • Pre-population of how multiple Attorneys are to act
  • Pre-population of Authority to Someone Else and Medical Treatment sections (Enduring POA)
  • Pre-population of Commencement section
  • Option for how the Principal is to sign
  • Option for Person Acting's details to pre-populate as a Witness
  • Pre-population of Attorney (and Substitute Attorney for Enduring POA) signing clauses where entered in your matter
These features will reduce the amount of manual manipulation of the forms required by you. These features work as instructed below (displaying Enduring POA examples) -
  • The forms now run a FILLIN as to which Client the form is to be completed for - choose option A for Client 1 or option B for Client 2:

  • Where multiple Attorneys (and multiple Substitute Attorneys for Enduring POA) are entered within your matter, you will now be asked how the Attorneys are to be appointed. Once selection is made for (A), (B), (C), or (D) the form will automatically cross out the remaining options thereby reducing the need for you to edit the document manually:

  • Options now included forAuthority to Someone Else and Medical Treatment (Enduring POA) sections. Once selection made for (A), (B), or (C), the form will automatically cross out the remaining options:

  • Option now included for Commencement section. Once selection made for (A), (B), or (C), the form will automatically cross out the remaining options:

  • You can now choose who is signing the POA - choose option A for the Principal, or option B for another person directed by the Principal (and the form will delete the option not selected):

  • You also have the option to select whether the Person Acting will witness the Principal's signature (if Yes the Person Acting's details will populate in the Witness 1 section):

  • To achieve these changes, it is important that your matter is completed correctly and the necessary table types completed. The Attorney(andAlternative Attorneyfor Enduring POA) and, where you have two Clients in a matter, the Client 2 Attorney(andClient 2 Alternative Attorneyfor Enduring POA), table types must be completed as follows:

Reminder: You can manually edit any section of the forms, by simply placing your cursor on the section to edit, clickingConvert Fields to Textin the LEAP ribbon and manually editing. Note: all coding is based on ClientthereforeDO NOTuse Wife's Attorney/Wife's App Guardian or Husband's Attorney/Husband's App Guardian in any of the table types in the 3 matter types.   1. Right-click on Client 1
  2. Select either New Client and enter the new client details; or
  3. Select Add Client from Cards List and select the client from the cards list window that opens.
