VIC - State Revenue Office - updated Duties Forms

The State Revenue office has updated some of their Duties Forms - these forms have specific uses and are not to replace the Duties Online forms.
  • Application for First Home Owner Grant (LL-VIC-SRO-410)
  • Eligible first home buyers duty reduction/exemption or concession declaration (LL-VIC-SRO-409)
  • Family farm exemption statutory declaration(LL-VIC-SRO-025)
  • First home owner exemption/concession declaration(LL-VIC-SRO-398)
  • Off-the-plan sales statutory declaration(LL-VIC-SRO-297)
  • Pensioner exemption/concession declaration(LL-VIC-SRO-399)
  • Primary production and water entitlements (for all land types) statutory declaration(LL-VIC-SRO-015)
  • Principal place of residence (PPR) concession and eligible first home buyer duty reduction declaration(LL-VIC-SRO-408)
  • Young farmers exemption/concession claim form(LL-VIC-SRO-348)
Below is important information taken directly from the State Revenue Office website regarding these forms and their use - Application for First Home Owner Grant

This form must be used to apply for the First Home Owner Grant for - Contracts signed on or after 1 July 2013, or Contracts signed on or before 30 June 2013 where the eligible transaction completes or settles on or after 1 July 2013 -

*Note: This form will soon be replaced with an online SmartForm. Once this SmartForm is available the current document will no longer exist.

First Home owner exemption/concession declaration

Duties Form 07E has been replaced by the digital duties form, except for the purposes of a refund. Duties Form 7E, should only be used if you are applying for a duty refund in relation to the first home owner exemption/concession on the purchase of a property.

If you are applying for a first home owner exemption/concession on the purchase of a property, where the contract was entered into on or after 1 July 2012, please use the digital duties form.

Note:This formmust be lodged electronicallywith the SRO. Paper-based submissions will be returned.

Off the plan sales statutory declaration – contracts dated from 01-10-2008 (Duties Form 04AA)

*Note: Duties Form 04A has been replaced by the digital duties form, except for the purposes of a refund. If you are applying for a concession from duty for off-the-plan contracts, relating to both land and building packages and refurbished lots, please use the digital duties form. Duties Form 4A should only be used if you are applying for a duty refund in relation to an off-the-plan transaction.

Note:This formmust be lodged electronicallywith the SRO. Paper-based submissions will be returned.

Pensioner exemption/concession declaration

Duties Form 08F has been replaced by thedigital duties form,except for the purposes of a refund.If you are applying for a pensioner exemption/concession,please use the digital duties form.Duties Form 8F, below, should only to be used if you are an eligible pensioner who hasnot claimed the exemption/concession and paid full duty.The declaration must be lodged within five years of the date that duty was paid.

Note:This formmust be lodged electronicallywith the SRO. Paper-based submissions will be returned.

Primary production and water entitlements (for all land types) statutory declaration

If your transaction was exemptbut you did not claim the exemption from duty oneligible primary production goods, water rights and disaggregation of primary production land at therelevanttime, you may be entitled to a duty refund. Youshould use Duties Form 12 to claim that refund.

Note:This formmust be lodged electronicallywith the SRO. Paper-based submissions will be returned.

Principal place of residence (PPR) concession and eligible first home buyer duty reduction declaration

Duties Form 53D, should only to be used if you are applying for a duty refund in relation to a principal place of residence (PPR) concession.

Young farmers exemption/concession claim form

Duties Form 56, should only be used if you are applying for a duty refund in relation tothe young farmers duty exemption/concession on the purchase of a first parcel(s) of farmland.
