VIC - Wills

The Wills matter types in LEAP have been updated to more accurately reflect modern relationships, to improve the quality of information that can be recorded on the electronic matter and to maximise automation within the LEAP forms and precedents. The matter types are now:-
  • Wills - Single
  • Wills - Mutual
Each matter type has been set to default to:-
Wills - SingleWills - Mutual
Client = ClientClient = Client
Other Side = ExecutorOther Side = Substitute Executor
Other Side's Solicitor = Substitute ExecutorOther Side's Solicitor - Client 2 Substitute Executor
The majority of changes have been made to the Wills - Mutual matter type. Wills - Mutual has been set up so that it can be used for any relationship, whether Husband and Wife, Defacto, Domestic Partners, Mother and Daughter, Siblings, etc. The matter has been set up so that each Table also has a "Client 2" equivalent. This way you can see which party belongs to each of your Clients and it also allows you to easily have different people appointedfor each Client. To set up the Mutual matter type simply add your first Client and then add a Second Client to the matter. As the name of the Matter Type suggests, each client will automatically be the Executor of the other Client's Will. ASubstitute Executor can be added which relates to Client 1 and Client 2 Substitute Executor can be added for Client 2. If both clients are to have the same Substitute Executor simply add that person's card to both Substitute Executor and Client 2 Substitute Executor Tables. Complete each Table that you require in the matter noting that all of the "Client 2 ..." Tables will relate to the second Client Card in your matter. Again, if the same person is to be appointed for both of your Clients simply add their Card twice. We have also added a Details Layout to the Client Table in which you can record the relationship to the Other Client in the matter, ie. Client 1's relationship to Client 2 is Husband. Client 2's Relationship to Client 1 is Wife. Each of the other Tables on the matter also has a Relationship layout which allows you to record the relationship to the Client. All of the precedents in LEAP have been updated to use this coding. If, however, you have your own precedent Wills you will need to re-code your documents. The followinghas been created to assist you to replace the fields in your firm specific precedents so that they will automate with the new matter types. The following card types have been replaced, which means that most of your existing fields will only require an update to the table type not the field:

The following new tables and fields have been created and may assist in automating your precedents further:

Calculations This next section is for the more advanced precedent administrators, as you may wish to automate your firm specific precedents using calculations for your Wills – Mutual matter type. By using ASK and IF-THEN-ELSE calculations in your precedents, the same Will can be used for either party where traditionally you may have had two separate Will precedents (ie. Husband Will and Wife Will). To create an ASK:
  1. Insert a Bookmark into your precedent. The bookmark must be one word and cannot contain any numbers or characters (text only). For this example, we have created a bookmark called Client.
  2. Select the option to ‘Create LEAP Ask' from the LEAP toolbar and select the Bookmark, create a prompt and a default answer.
  3. You can then insert an ‘If Then Else' into any section of the precedent which requires a variable dependent on whether you select to prepare the Will for Client 1 or Client 2.

NB: In the short term, if you have not re-coded your documents, the Tables that were previously used in these matter types can be found in the Other Possible Table Types and you can move them back into the matter to use your existing precedents. Please note however that your documents should be re-coded as soon as possible as these old Tables will be deleted from Other Possible Table Types in the near future.
