VIC - Estate matter types

Incorrect use of Matter Types in Estate Matters It has come to our attention via the Victorian Probate Registrar that some our clients' forms are not completing correctly. We have identified that this issue is due to clients not selecting the correct Matter Type. When applying for a Grant, you need to choose one of the following Matter Types :-
  • PROBATE–where there is a valid Will and a named Executor who is willing to act;
  • LETTERS OF ADMINISTRATION WITH THE WILL ANNEXED – where there is a valid Will however the Instituted Executor has died, renounced, cannot be found, is unable or unwilling to act. Also required if the Executor has died after the grant of Probate without appointing an Executor in his Will; or
  • LETTERS OF ADMINISTRATION–where there is no valid Will.
If you are not selecting the correct Matter Type your forms will not be completed correctly and they may be rejected by the Probate office on lodgment. Attached is a Matter guide which explains how to complete your matters correctly. Please ensure that the correct matter type is selected when setting up your matter.
