WA - Criminal Law

The Criminal Law matter types for Western Australia have been updated in order to improve the quality of information that can be recorded on the electronic matter and to maximise automation in forms and precedents. Some of the most significant updates include:
  • New and improved tables to record further details about the accused and charge details
  • Simplified data-entry process for criminal matters that are appealed to a higher court; and
  • The introduction of a critical date scheme to record important hearing dates and service requirements.
The relevant forms for Western Australia have also been updated to reflect these changes, but will still integrate with your existing Criminal Law matter types. IMPORTANT: Any existing matters will not automatically contain these changes. If you would like to see these changes applied to existing matters you will need to change the Matter Type then re-select the relevant Matter Type for the changes to be applied. This process may result in the duplication of Cards, and you may need to remove former table types from your matter using the Edit Table Types menu. Matter Type Updates The default ‘Client' and ‘Otherside' tables are now Accused and Prosecutor for all Criminal Law matter types except Criminal Appeal. The default tables for this matter type have been retained as Appellant and Respondent. The matter type defaults for Restraining Order remain unchanged. New Layouts The following new layouts have been created:
  • Bail / Remand Details, incorporating bail status, conditions and surety details and also allows the user to record the date the accused was remanded in custody.
  • Arresting officer details, containing the officer's rank and badge number.
  • Criminal Charge Details, a new and improved table including options for the Charge, Act and Section of the offence and whether it is a summary or indictable offence. The new table also allows for a period of offending, not just a date of offence and allows the user to select whether the accused is being dealt with as an adult or juvenile and whether there are any co-accused. This table also contains a new TAB where the user can record the Outcome in relation to each particular charge.
New Cards As previously referred to, a new card has been created for Arresting Officer so that the details of the police officer responsible for the arrest of the Accused can be recorded. Critical Dates A critical date scheme has been created so that the user can record important hearing dates and service requirements. The introduction of critical dates will also allow you to create firm specific Agenda and Workflow items based on these dates to further assist with practice management. The critical dates for Western Australia criminal matter types are as follows:

  • Committal Hearing Date
  • Trial Allocation Date
  • Status Conference Date
  • Notice of Acting Due Date
  • Listing Certificate Due Date
  • Trial Listing Hearing Date
  • Pre-Trial Hearing Date
  • Defence Disclosure Due Date
  • Hearing Date
  • Trial Date
  • Initial Sentence Mention Date
  • Sentence Mention Date
  • Sentence Hearing Date
  • Appeal Period Expiry Date
  • Notice of Appeal Lodged Date
  • Case / Answer Due Date
