 LEAP has added new forms relating to the Property Law Act 2023 (Qld) commencing 1 August 2025 to the Conveyancing & Property area of law in QLD as follows:

  • Form 1 - Notice of default under instalment contract [LL-QLD-PR-337]
  • Form 3 - Notice of exercise of power of sale [LL-QLD-PR-339]
  • Form 4 - Notice of intention to exercise power of sale for disclaimed property [LL-QLD-PR-340]
  • Form 5 - Notice of sale by mortgagee [LL-QLD-PR-341]
  • Form 6 - Appointment of receiver [LL-QLD-PR-342]
  • Form 7 - Notice to remedy breach [LL-QLD-PR-343]
  • Form 8 - Breach Notice—Intention to refuse to renew or extend the term of or sell the reversion of a lease [LL-QLD-PR-344]
  • Form 9 - Notice to terminate lease [LL-QLD-PR-345]
  • Form 2 - Seller disclosure statement [LL-QLD-PR-338]

LEAP has added to and updated the Lexon Conveyancing Protocol Pack suite of forms in the QLD Conveyancing matter types in accordance with the updated Property Law Act 2023 (Qld) commencing 1 August 2025.

TRANSITIONAL ISSUES

Contract formation 

  1. For contracts formed and settling before 1 August, use the packs marked Conveyancing Protocol for use for Contracts formed before 1 August 2025 – available from Lexon’s website
  2. For contracts formed before 1 August but settling after that date, use Conveyancing Protocol for use for Contracts formed before 1 August 2025 available from Lexon’s website. However, also consider the provisions in PLA23 that commence on 1 August that may affect the matter, including damage to property (s77), inoperative computers (ss 79 and 80), adverse events (s81), and Instalment Contracts (Division 3), and adapt the packs accordingly in your specific matter circumstances; and 
  3. For contracts formed from 1 August use the new updated packs marked Conveyancing Protocol for use for Contracts formed from 1 August 2025 – available through our platform

Contract versions 

It will also be critical that you check contract versions for contracts formed around 1 August and that any Seller Disclosure was given after 1 August. Any contract formed from 1 August 2025 using prior contract versions will necessitate significant changes to the Protocol documents used for that conveyance, which your practice would need to consider in the specific circumstance. It will be prudent to provide advice to your client, from the outset, on the risks and options of a prior contract version being used for Contracts formed from 1 August.
